Conditions

Overview

The Policy on Ability and Accessibility delineates the conditions, principles, and protections for ability accommodation, capacitation, and protection that are integral to the Agreement you enter into whenever — and wherever — you commence or continue any conduct or service relating in any way, directly or indirectly, to The Ikoku Center. Please, therefore, take the time to read what follows carefully.

I — Your Policy Agreements

— first, with respect to the Ability and Accessibility Policy you enter into via your Agreement with the Codes and Policies, you understand and agree to abide by the following:

i. Policy: Name, Nature
that the name of this Policy is the “Policy on Ability and Accessibility of The Alvan Ikoku Center” (the “Ability and Accessibility Policy,” the “Ability Policy,” the “Accessibility Policy,” and the “Disability Policy”) and that the nature of this Policy is to serve as the policy on ability, accessibility, and disability of The Alvan Ikoku Center.
ii. Policy: Composition
that the Ability and Accessibility Policy consists of all conditions, principles, protections, and equivalent provisions for ability accommodation, capacitation, and protection in the Codes and Policies of The Alvan Ikoku Center (the “Codes and Policies” and the “Policies”) and The Ikoku Center Conduct and Service Agreement (the “Agreement”), which therefore include, but are not limited to, those delineated below.
iii. Policy: Agreement
that you understand the Ability and Accessibility Policy to be an integral part of the Codes and Policies and the Agreement you enter into with The Ikoku Center.
iv. Policy: Consent
that your consent to the Codes and Policies and the Agreement includes your legally equivalent consent to the Ability and Accessibility Policy.
v. Policy: Duties
that your duties to the Codes and Policies and the Agreement includes your legally equivalent duties to the Ability and Accessibility Policy.
vi. Policy: Entry
that your entry into the Agreement includes your legally equivalent entry into the Ability and Accessibility Policy, and similarly occurs whenever you commence or continue any conduct or service at, by, for, in, on, with or otherwise relating to The Ikoku Center.
vii. Policy: Legally Abiding
that your attestation about your reading, understanding, consenting and agreeing to legally abide by the Codes and Policies and the Agreement includes your legally attestation about your reading, understanding, consenting and agreeing to legally abide by the Ability and Accessibility Policy, in its entirety without modification or severability, as amended from time to time solely by the Founder.
viii. Policy: Legally Binding
that your attestation about your reading, understanding, consenting and agreeing to be legally bound by the Codes and Policies and the Agreement includes your legally equivalent attestation about your reading, understanding, consenting and agreeing to be legally bound by the Ability and Accessibility Policy, in its entirety without modification or severability, as amended from time to time solely by the Founder.
ix. Policy: Knowledge
that your attestation about your awareness and acceptance of your responsibility to keep informed and update your knowledge of the Codes and Policies and the Agreement includes your legally equivalent awareness and acceptance of your responsibility to keep informed and update your knowledge of the Ability and Accessibility Policy, in its entirety without modification or severability, as amended from time to time solely by the Founder.

II — Your Policy Understandings

— second, with respect to your understandings of the Ability and Accessibility Policy, you covenant, represent, and warrant the following:

i. Understanding: Ability, Accessibility
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
ii. Understanding: Ability, Accessibility Conditions
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility conditions as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation, to be fulfilled and respected and not breached or violated, in any way, by you.
iii. Understanding: Ability, Accessibility Definitions
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility definitions as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation, to be fulfilled and respected and not breached or violated, in any way, by you.
iv. Understanding: Ability, Accessibility Practices
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility practices as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation, to be fulfilled and respected and not breached or violated, in any way, by you.
v. Understanding: Ability, Accessibility Principles
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility principles as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation, to be fulfilled and respected and not infringed or violated, in any way, by you.
vi. Understanding: Ability, Accessibility Processes
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility processes as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation, to be fulfilled and respected and not breached or violated, in any way, by you.
vii. Understanding: Ability, Accessibility Rights
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility rights as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation, to be fulfilled and respected and not infringed or violated, in any way, by you.
viii. Understanding: Ability, Accessibility Safeguards
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility safeguards and resulting protections as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation, to be fulfilled and respected and not breached or violated, in any way, by you.
ix. Understanding: Ability, Accessibility Violations
that you have read, understood, consented to, and agreed to be legally bound by and abide by understandings of ability and accessibility breach, diminishment, incompatibility, infringement, and violation as they are defined and provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation, to not be brought about, in any way, by you.

III — Your Policy Commitments

— third, with respect to your commitments to the Ability and Accessibility Policy, you understand and agree to abide by the following:

i. Commitment: Basis
that your commitment is the basis for any conduct or service at, by, for, in, on, with, or otherwise relating to The Ikoku Center that you commence or continue — including via any of the Products or Services, or the divisions, series, subsidiaries, or affiliates — and that any such conduct or service is free of any incompatibility with The Ikoku Center or violation of the Ability and Accessibility Policy, the Codes and Policies, or applicable law or regulation.
ii. Commitment: Ability, Accessibility
that this commitment include but not be limited to upholding for every person at The Ikoku Center the most humane, protective and respectful interpretations of ability and accessibility, including as provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
iii. Commitment: Ability, Accessibility Conditions
that this commitment include but not be limited to upholding for every person at The Ikoku Center the most humane, protective and respectful interpretations of ability and accessibility conditions, including as provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
iv. Commitment: Ability, Accessibility Definitions
that this commitment include but not be limited to upholding for every person at The Ikoku Center the most humane, protective and respectful interpretations of ability and accessibility definitions, including as provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
v. Commitment: Ability, Accessibility Principles
that this commitment include but not be limited to upholding for every person at The Ikoku Center the most humane, protective and respectful interpretations of ability and accessibility principles, including as provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
vi. Commitment: Ability, Accessibility Processes
that this commitment include but not be limited to upholding for every person at The Ikoku Center the most humane, protective and respectful interpretations of ability and accessibility processes, including as provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
vii. Commitment: Ability, Accessibility Rights
that this commitment include but not be limited to upholding for every person at The Ikoku Center the most humane, protective and respectful interpretations of ability and accessibility rights, including as provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
viii. Commitment: Ability, Accessibility Safeguards
that this commitment include but not be limited to upholding for every person at The Ikoku Center the most humane, protective and respectful interpretations of ability and accessibility safeguards and resulting protections, including as provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
ix. Commitment: Your Duty, Practices
that you respectfully assist solely via Your Duties as described in the Codes and Policies and the Ability and Accessibility Policy and in no way interfere with or impede the reasonable efforts authorized and executed solely by the Founder to translate the above commitments into practices for adopting and applying policies pertaining to ability and accessibility; for adjudicating and determining compliance with the policies; and for fulfilling The Ikoku Center’s own duties pertaining to ability and accessibility, ability and accessibility conditions, ability and accessibility definitions, ability and accessibility principles, ability and accessibility processes, ability and accessibility rights, and ability and accessibility safeguards and their resulting protections, including as provided for in the Ability and Accessibility Policy, the Codes and Policies, and applicable law and regulation.
x. Commitment: Your Duty, Protections
that you also respectfully assist solely via Your Duties as described in the Codes and Policies and the Ability and Accessibility Policy and in no way interfere with or impede the reasonable efforts authorized and executed solely by the Founder to develop and enforce ability and accessibility protections derived from, first, applicable law and regulation, and second, from advances in ability and accessibility that protect persons in ways that go beyond what such law and regulation currently provides.

Principles

Provision

The Policy on Ability and Accessibility requires your adherence to the conditions above and correlative conditions and principles delineated below.

A — On Ability

Conditions for Ability

— With respect to conditions for ability, you understand and agree to abide by the following:

i. Conditions, Ability
that, in addition to your Agreement, you maintain and not infringe, in any way, the ensuing conditions for ability, which depend on the enabling and protective nature of The Alvan Ikoku Center — including its official entities, persons, the Founder, and The Ikoku Center Administration — as an enabling and protective corporation and organization and as entities and persons of enabling and protective administration.
ii. Conditions, Ability: Administration
that the enabling and protective administration of The Ikoku Center and The Ikoku Center Administration and the rights attendant to such ability — as conducted solely by the Founder, Alvan Azinna Chibuzo Ikoku, and executed solely via the Founder’s authorization — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
iii. Conditions, Ability: Areas
that the enabling and protective administration of the official areas of The Ikoku Center and The Ikoku Center Administration and the rights attendant to such ability — including that providing for and otherwise pertaining to the ability of its official areas, offices, parts, properties, sections, and equivalent, as authorized solely by the Founder, Alvan Azinna Chibuzo Ikoku — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
iv. Conditions, Ability: Founder
that the ability of The Ikoku Center’s Founder, Alvan Azinna Chibuzo Ikoku, and the rights attendant to such ability — including that providing for and otherwise pertaining to the ability of the Founder, his activities, administration, conduct and service, as executed solely by the Founder’s authorization — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
v. Conditions, Ability: Ownership
that the enabling and protective ownership of The Ikoku Center and The Ikoku Center Administration and the rights attendant to such ability — including that providing for and otherwise pertaining to the enabling and protective interests-, share-, stake- and stock-holding, ownership, and equivalent of The Ikoku Center and The Ikoku Center Administration, solely and wholly by the Founder, Alvan Azinna Chibuzo Ikoku — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
vi. Conditions, Ability: Practices
that the enabling and protective practices of The Ikoku Center and The Ikoku Center Administration and the rights attendant to such ability — including that providing for and otherwise pertaining to practices for ensuring the ability of The Ikoku Center, The Ikoku Center Administration, its official entities, persons, the Founder, and its conduct and service, as authorized solely by the Founder, Alvan Azinna Chibuzo Ikoku — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
vii. Conditions, Ability: Reporting
that the enabling and protective reporting of actual, anticipated or apparent infringement relating to The Ikoku Center and The Ikoku Center Administration and the rights attendant to such ability — including that providing for and otherwise pertaining to the enabling and protective reporting of any infringement or equivalent of the Codes and Policies and applicable law and regulation, directly to and fully informing the Founder, Alvan Azinna Chibuzo Ikoku — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.

Duties for Ability

— With respect to duties for ability, you understand and agree to abide by the following:

i. Duty, Ability: Activity
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability — including the enabling and protective administration — of an act or activity.
ii. Duty, Ability: Agent
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability — including ableness, capability, capacity, disableness, and disability — of an agent or party.
iii. Duty, Ability: Arrangement
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability — including the enabling and protective administration — of an arrangement.
iv. Duty, Ability: Conduct, Service
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability — including the enabling and protective administration — of a conduct or service.
v. Duty, Ability: Entity, Organization
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability of The Alvan Ikoku Center — including its official entities, persons, the Founder, and The Ikoku Center Administration — as an enabling and protective corporation and organization and as entities and persons of enabling and protective administration.
vi. Duty, Ability: Expectation
that you and The Ikoku Center have a duty to heed and not infringe, in any way, any expectation of ability — such as in the setting of protecting and valuing difference and diversity in ableness, capability, capacity, disableness, and disability — that is meaningful and reasonable.
vii. Duty, Ability: Material
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability — including the enabling and protective administration — of a material.
viii. Duty, Ability: Matter
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability — including the enabling and protective administration — of a matter.
ix. Duty, Ability: Procedure
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability — including the enabling and protective administration — of a procedure, proceeding, or process.
x. Duty, Ability: Relation
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the ability — including the enabling and protective administration — of a relation or relationship to an entity, office, or person.
xi. Duty, Ability: Request
that you and The Ikoku Center have a duty to consider then not infringe, in any way, a request for ability — such as in the setting of protecting and valuing difference and diversity in ableness, capability, capacity, disableness, and disability — that is meaningful and reasonable.
xii. Duty, Ability: Reporting
that your sole means of fulfilling the aforementioned duties is by refraining from and reporting — via fully informing communication directly to the Founder — any infringement of ability, and furthermore, not in any way diminishing or hindering the Founder’s sole discretion and powers to adjudicate and remedy such infringements.

Rights for Ability

— With respect to rights for ability, you understand and agree to abide by the following:

i. Rights, Ability: Applicable Law
that you and The Ikoku Center do not infringe, in any way, the rights for ability — as they pertain to protecting and valuing difference and diversity in ableness, capability, capacity, disableness, and disability — accorded to persons by applicable law and regulation.
ii. Rights, Ability: Civil, Fundamental
that you and The Ikoku Center do not infringe, in any way, the rights for ability — as they pertain to protecting and valuing difference and diversity in ableness, capability, capacity, disableness, and disability — accorded to persons by their polities.
iii. Rights, Ability: Entity, Organization
that you and The Ikoku Center do not infringe, in any way, the hereby accorded rights for ability of The Alvan Ikoku Center — including its official entities, persons, the Founder, and The Ikoku Center Administration — as an enabling and protective corporation and organization and as entities and persons of enabling and protective administration.
iv. Rights, Ability: Human, Being
that you and The Ikoku Center do not infringe, in any way, the hereby accorded rights for ability — as they pertain to protecting and valuing difference and diversity in ableness, capability, capacity, disableness, and disability — of a human’s inner being, body, and brain, as well as inner self, soul, and spirit.
v. Rights, Ability: Human, Mind
that you and The Ikoku Center do not infringe, in any way, the hereby accorded rights for ability — as they pertain to protecting and valuing difference and diversity in ableness, capability, capacity, disableness, and disability — of a human’s mind, including its cognitions, physicality, and physiology.
vi. Rights, Ability: Human, Self
that you and The Ikoku Center do not infringe, in any way, the hereby accorded rights for ability of a human’s activities with the self — as they pertain to protecting and valuing difference and diversity in ableness, capability, capacity, disableness, and disability.

Safeguards of Ability

— With respect to safeguards for ability, you understand and agree to abide by the following:

i. Safeguards, Ability: Activity
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability — including the enabling and protective administration — of an act or activity.
ii. Safeguards, Ability: Agent
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability — including ableness, capability, capacity, disableness, and disability — of an agent or party.
iii. Safeguards, Ability: Arrangement
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability — including the enabling and protective administration — of an arrangement.
iv. Safeguards, Ability: Conduct, Service
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability — including the enabling and protective administration — of a conduct or service.
v. Safeguards, Ability: Entity, Organization
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability of The Alvan Ikoku Center — including its official entities, persons, the Founder, and The Ikoku Center Administration — as an enabling and protective corporation and organization and as entities and persons of enabling and protective administration.
vi. Safeguards, Ability: Expectation
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to fulfill and safeguard an expectation of ability that is meaningful and reasonable.
vii. Safeguards, Ability: Material
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability — including the enabling and protective administration — of a material.
viii. Safeguards, Ability: Matter
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability — including the enabling and protective administration — of a matter.
ix. Safeguards, Ability: Procedure
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability — including the enabling and protective administration — of a procedure, proceeding, or process.
x. Safeguards, Ability: Relation
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to safeguard the ability — including the enabling and protective administration — of a relation or relationship to an entity, office, or person.
xi. Safeguards, Ability: Request
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to fulfill and safeguard a request for ability that is meaningful and reasonable.
xii. Safeguards, Ability: Rights
that you do not infringe, in any way, the practices, processes, protections, and other provisions of The Ikoku Center to fulfill and safeguard the aforementioned and other rights for ability, including but not limited to those provided for in the Codes and Policies and applicable law and regulation.
xiii. Safeguards, Ability: Reporting
that your primary means of respecting the aforementioned safeguards is by refraining from and reporting — via fully informing communication directly to the Founder — any infringement of ability, and furthermore, not in any way diminishing or hindering the Founder’s sole discretion and powers to adjudicate and remedy such infringements.

B — On Accessibility

Conditions for Accessibility

— With respect to conditions for accessibility, you understand and agree to abide by the following:

i. Conditions, Accessibility
that, in addition to your Agreement, you maintain and not infringe, in any way, the ensuing conditions for accessibility, which depend on the accommodative and facilitative nature of The Alvan Ikoku Center — including its official entities, persons, the Founder, and The Ikoku Center Administration — as an accommodative and facilitative corporation and organization and as entities and persons of accommodative and facilitative administration.
ii. Conditions, Accessibility: Administration
that the accommodative and facilitative administration of The Ikoku Center and The Ikoku Center Administration and the rights attendant to such accessibility — as conducted solely by the Founder, Alvan Azinna Chibuzo Ikoku, and executed solely via the Founder’s authorization — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
iii. Conditions, Accessibility: Areas
that the accommodative and facilitative administration of the official areas of The Ikoku Center and The Ikoku Center Administration and the rights attendant to such accessibility — including that providing for and otherwise pertaining to the accessibility of its official areas, offices, parts, properties, sections, and equivalent, as authorized solely by the Founder, Alvan Azinna Chibuzo Ikoku — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
iv. Conditions, Accessibility: Founder
that the accessibility of The Ikoku Center’s Founder, Alvan Azinna Chibuzo Ikoku, and the rights attendant to such accessibility — including that providing for and otherwise pertaining to the accessibility of the Founder, his activities, administration, conduct and service, as executed solely by the Founder’s authorization — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
v. Conditions, Accessibility: Ownership
that the facilitative and protective ownership of The Ikoku Center and The Ikoku Center Administration and the rights attendant to such accessibility — including that providing for and otherwise pertaining to the facilitative and protective interests-, share-, stake- and stock-holding, ownership, and equivalent of The Ikoku Center and The Ikoku Center Administration, solely and wholly by the Founder, Alvan Azinna Chibuzo Ikoku — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
vi. Conditions, Accessibility: Practices
that the accommodative and facilitative practices of The Ikoku Center and The Ikoku Center Administration and the rights attendant to such accessibility — including that providing for and otherwise pertaining to practices for ensuring the accessibility of The Ikoku Center, The Ikoku Center Administration, its official entities, persons, the Founder, and its conduct and service, as authorized solely by the Founder, Alvan Azinna Chibuzo Ikoku — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.
vii. Conditions, Accessibility: Reporting
that the accommodative and facilitative reporting of actual, anticipated or apparent infringement relating to The Ikoku Center and The Ikoku Center Administration and the rights attendant to such accessibility — including that providing for and otherwise pertaining to the accommodative and facilitative reporting of any infringement or equivalent of the Codes and Policies and applicable law and regulation, directly to and fully informing the Founder, Alvan Azinna Chibuzo Ikoku — are actively attained, maintained, protected, and secured, are fully enjoyed and fulfilled, and are not infringed in any way.

Duties for Accessibility

— With respect to duties of accessibility, you understand and agree to abide by the following:

i. Duty, Accessibility: Activity
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the accessibility — including the accommodative and facilitative administration — of an act or activity.
ii. Duty, Accessibility: Agent
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the accessibility — including needs for accommodating difference and diversity in ableness, capability, capacity, disableness, and disability — of an agent or party.
iii. Duty, Accessibility: Arrangement
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the accessibility — including the accommodative and facilitative administration — of an arrangement.
iv. Duty, Accessibility: Conduct, Service
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the accessibility — including the accommodative and facilitative administration — of a conduct or service.
v. Duty, Accessibility: Entity, Organization
that you and The Ikoku Center have a duty to maintain and not infringe, in any way, the accessibility of The Alvan Ikoku Center — including its official entities, persons, the Founder, and The Ikoku Center Administration — as an accommodative and facilitative corporation and organization and as entities and persons of accommodative and facilitative administration.
vi. Duty, Accessibility: Expectation
that you and The Ikoku Center have a duty to heed and not infringe, in any way, any expectation of accessibility — such as in the setting of accommodating and providing for difference and diversity in ableness, capability, capacity, disableness, and disability — that is meaningful and reasonable.
vii. Duty, Accessibility: Material
